The Tulsa County District Attorney’s office said Wednesday that charges were being dropped against Brett Reamy, the man suspected of committing sexual assault in a Tulsa park.
Reamy, 42, was originally arrested in September as a suspect in the sexual assault of a woman in Hunter Park in south Tulsa last August. The Tulsa County District Attorney’s Office charged Reamy with one count of rape by instrumentation and booked him into the Tulsa County Jail.
But on Wednesday, District Attorney Steve Kunzweiler said a factual alibi for Reamy emerged, “which made the probability of him being able to perpetrate this crime unlikely.” Other information collected during the ongoing investigation substantiated the alibi, so the case against him was dismissed pending further investigation.
“Our mission is to find truth and seek justice, wherever it may lead. When someone is arrested for a crime, they enjoy the presumption of innocence until a judge or jury determines they are guilty based on the evidence presented in court,” Kunzweiler said in a statement.
Kunzweiler said his office has been in contact with the Tulsa Police Department and they will continue to work to “bring the perpetrator of this crime to justice.
“Recreational parks and facilities in our community have dutifully responded to criminal incidents with enhanced security and surveillance measures, benefiting our community, and subsequently providing law enforcement, and my office with more tools to address crime.
“We encourage our community to remain good citizens by reporting suspicious activity to our law enforcement partners while they enjoy living, working, and playing in this great community of Tulsa County.”
At approximately 6:15 p.m. on Aug. 21, Tulsa police responded to a report of an assault at the park located near 5800 E. 91st St.
According to the victim, a white male in his 40s or 50s approached her while she was walking in a wooded area of the park. The suspect physically attacked the victim and assaulted her sexually. During the attack, the victim sustained injuries.
Police said they had interacted with Reamy shortly after the incident but there wasn’t enough of a description at the time to identify him as a suspect. Detectives said they collected evidence from multiple sources that placed Reamy inside Hunter Park at the time of the assault, and the victim identified Reamy as the suspect in a photo lineup.
