A man who shot a Broken Arrow Police officer in the arm in 2020 has been given a deferred sentence.
Court records show Dean Black was slated to go to trial last month but he entered a plea of no contest and received a 1-year deferred sentence from a Tulsa County District Court judge.
If Black follows the terms of his sentence, the case will be expunged from his record. Black will also not be under supervision during the sentence.
Broken Arrow Police Chief Brandon Berryhill said Tuesday he did not agree with the sentence, feeling it did not fit the seriousness of the crime.
“I stand behind the work police officers do every day and we will continue to do our job regardless of what is outside our control,” Berryhill said.
On May 17, 2020, Hayden Payne went to a home near 81st Street and Aspen Avenue and shot a gun at Black. Black went back inside the home and Payne drove away.
Officer Cody Stanton later approached the home to investigate, knocked on the front door and, according to police reports, Black shot a gun through the door, hitting Stanton in the arm.
Police said Stanton took cover, applied a tourniquet and was later taken to the hospital.
Court records show Payne plead guilty in 2021 and was sentenced to 8 years in prison and 2 years probation on 3 counts of assault with a dangerous weapon.
