A Tulsa resident is facing charges stemming from a road-rage incident Sunday afternoon in Broken Arrow.
Broken Arrow police said Miguel Casimiro Hernandez, 38, was arrested for unlawful possession of a firearm, assault with a deadly weapon and possession of a firearm while committing a felony.
Hernandez was booked into the Tulsa County Jail and charges are presented to the Tulsa County District Court. According to the police report, Hernandez is an illegal immigrant and doesn’t reside legally in the U.S.
According to a police report of the incident, officers were dispatched to the area of 2200 W. Highway 51 eastbound, near Aspen Avenue, after receiving calls about a road-rage incident that turned into an assault. Witnesses told dispatchers a man exited the truck and was beating on the windshield of a black van driven by Hernandez.
Witnesses said Hernandez hit the other male with the van and he fell under the vehicle. Hernandez continued to drive over the male, dragging him under it and eventually running him over.
The van driver continued south on Aspen, leaving the scene. A Broken Arrow officer located Hernandez, who told police he was traveling east on Highway 51 when traffic became heavy and a Hispanic male in a white pickup truck got angry at him and “started to road rage.”
Traffic came to a stop and the driver of the white pickup exited the vehicle and approached Hernandez’s van, the report said. Hernandez told police the man began to yell “I’m going to kill you!” in Spanish and attempted to open his door.
According to police, Hernandez stated he pulled out a pistol and told the other man “Back up, I don’t want to shoot you.”
The other man continued to yell and threaten Hernandez, who was able to close his door. The report says the man stated to Hernandez, “If you have to pull out a gun, you have to use it,” and he walked to the front of the van and block Hernandez from leaving.
According to Hernandez, the man said, “you’re not going anywhere, I’m going to call the cops” and started busting the van’s windshield with his hands. Hernandez then accelerated the van and hit the other man. Police said they located black 9mm pistol in the vehicle.

Witnesses told police Hernandez did not stop after striking the man and did not attempt to call police.
No information was available Monday morning on the condition of the man that was run over. On Sunday police said he had been taken to a hospital with life-threatening injuries.
